General terms and conditions
1 – Introduction
Our general terms and conditions are binding for any order passed and executed through the web shop addressed to consumers (BtoC) of the company Egmont Toys SRL (hereafter Egmont Toys or the seller), registered in the trade register under nr 0465196855 (VAT nr BE0465196855). Our company address is Av. Zénobe Gramme, 11 in 1480 Saintes (Tubize), Belgium email: mail@egmonttoys.com.
This English version of our general terms and conditions is only made to help our customer. If there would be a difference of interpretation between the French and the English text, it is only the French text that is valid.
2 - General terms and conditions
The customer has the possibility to register or print these general terms and conditions. It is understood that registering or printing these conditions are the sole responsibility of the customer.
Egmont Toys can change the terms and conditions at any moment. The terms and conditions that are applicable on a specific agreement are the terms and conditions published on the website of Egmont Toys at the moment of the conclusion of the agreement.
Definitions
CONSUMER: any physical or legal person who acquires or uses products through the website of Egmont Toys for nonprofessional purposes
PROFESSIONAL: any person or entity not corresponding to the definition above.
3 – a sales transaction
A sale is only concluded by the confirmation mail of the seller, as a reply to the order sheet completed by the buyer. The buyer is the sole responsible for the exactness of the data in the order sheet.
Egmont Toys reserves the right to ask for additional information regarding an order and to refuse the order if the information is not satisfactory. E.g. if Egmont Toys has reason to believe that the buyer has the intention to resell the ordered goods or if there are doubts about the identity of the buyer
4 – Order confirmation
Egmont Toys will confirm the order and give an indication of the possible delivery date. If the indicated delivery date cannot be respected or if a product is no longer available, Egmont Toys will inform the customer and the customer has the possibility to modify or to cancel the order.
5 – Availability
The products on our website are in principle available, however this information is only an indication. Egmont Toys cannot be held accountable if a product would not be available after all.
Egmont Toys reserves the right to deliver an order in two or more parts if one or several ordered products would not be available. Egmont Toys will not charge extra costs for this.
6 – transfer of ownership and transfer of risk
Contrary to Art 1583 of the civil code, the sold or delivered goods remain the property of Egmont Toys till the complete payment of the order.
The risks attached to the ordered goods are transferred to the buyer at the moment of delivery.
7. Price
The prices of our products are indicated in Euro, including taxes (for deliveries in the EU) and without transport costs. Delivery and transport costs will be charged to the customer (except if indicated otherwise in specific conditions on the website).
Egmont Toys reserves the right to change prices at any moment. The price applicable for an order is the price at the moment of the order confirmation by Egmont Toys.
8 – Payment
An order will only be executed after the reception of the complete payment. The means of payment we accept are: Paypal, Apple Pay, Bancontact, Credit cards (Master Card and Visa) or others if specified on our website.
10 – Delivery
Products and services offered through the web shop of Egmont Toys are only available for the countries indicated on the website. Egmont Toys reserves the right to change these countries at any moment. The ordered products will be delivered at the address indicated in the order form. The possible delivery dates are only an indication. Egmont Toys is not responsible for the delays in the treatment of the deliveries by transporters.
Imports, taxes and customs
The buyer is sole responsible for import procedures, duties and taxes for products delivered outside of the EU.
Delivery
Any remark or reserve concerning a delivered product, e.g damage, incomplete delivery, wrong delivery, faulty product…) must be communicated to Egmont Toys by email within 2 days after the delivery of the product. In this e mail the buyer will give detailed information about the nature of the damage (description, photo’s), in such a way that Egmont Toys can propose an appropriate solution (spare parts, exchange, reimbursement….). If Egmont Toys sent the wrong product, Egmont Toys may ask to return the product. In that case Egmont Toys will reimburse the return transport costs after reception of the wrongly delivered product (in the original packing) and reimburse the order or change the product.
If the transporter delivers a damaged parcel (damage visible on the outside), the customer will ask the driver to make a note of this and communicate this info immediately to Egmont Toys, in order to be able to make a claim against the transporter.
Deliveries are executed by GLS. As soon as a parcel is ready for shipment, the Destinee receives an email with information about the planned delivery of the parcel with an estimation of the delivery time so that the Destinee can take the necessary steps to assure a swift delivery. The customer can choose amongst several delivery options: delivery at the indicated address, delivery in a parcel shop, parcel locker, another date…If the customer is absent for the first delivery and if he didn’t choose another option for the delivery within 7 days, Egmont Toys will only organize a second delivery when the parcel has been returned and when the customer pays the cost for the second delivery.
11 – Warranty
Egmont Toys respects the European regulations regarding warranty. In principle, the warranty period is 2 years. Of course, this warranty can only be respected with a normal use of the products according to the instructions of the manufacturer.
12 – right of return
According the law of the 21st December 2013 on market practices and online sales, the consumer has the right to return a product within 14 days after the delivery, without the obligation to motivate his decision to the seller for cancelling his order.
If the buyer wants to exercise this right, he has to send the goods back to Egmont Toys within 14 days after the delivery. The products being sent back have to be complete and in the original condition (with all parts and in the original packing) and with a copy of the order form or the invoice. An incomplete or damaged product will not be reimbursed or exchanged. The return transport costs will be paid by the buyer.
The delivery and transport costs made by Egmont Toys for the order will not be reimbursed.
Within 30 days after the reception of the return, Egmont Toys will reimburse, after deduction of the transport costs.
The right of return is not applicable for products sold during sales and promotion campaigns.
13 – GDPR – protection of data
When ordering through our web shop, you authorize Egmont Toys to store and use your data. If you wish not to do this, you can indicate this on the order form.
14 proof of transactions
The records stored on the servers of Egmont Toys (order forms, email communication, delivery notes, invoices, …) in acceptable security circumstances will be considered as proof for all transactions between Egmont Toys and customers.
15. Applicable law and jurisdiction
Egmont Toys will do its utmost best to resolve problems by mutual agreement. If this would not be possible, the courts of Brussels are competent and the Belgian law is applicable. Language for procedures will be French.
